Defending Sumitomo Chemicals in first effective compensation application, filed by Food Corporation of India (private antitrust litigation)

Food Corporation of India (FCI) has filed an application seeking compensation in aluminium phosphide cartel matter before the National Company Law Appellate Tribunal (NCLAT).  The said application was filed under S.53N of the Competition Act, 2002. This case assumes significance, as this is the first compensation application (private antitrust litigation), which has been filed after Supreme Court’s order in Excel Crop Care matter confirming violation of the Competition Act.
